Terms & Conditions of the “Retro Race $3,000 AUD Competition”

1. PROMOTION

1.1. Promotion: TWO SVGE’s Retro Race $3,000 AUD Competition (Promotion).

1.2. Promoter: The Nolan Bros Pty Ltd (ABN 22 640 869 030) (Promotor) trading as TWO SVGE, located at U1 4 Network Place, Forrestdale WA 6112.

1.3. Promotion Period: The Promotion commences on 19 August 2025 and ends on 18 September 2025 at 11:59pm AWST or as amended at the Promotor’s absolute discretion (Promotion Period).

2. ELIGIBILITY

2.1. The Promotion is open to persons that:

a) are residents of Australia, New Zealand, the United States, Canada, or the United Kingdom;

(b) are at least 16 years or older;

(d) are otherwise determined by the Promotor as eligible to participate in the Promotion in the Promotor’s absolute discretion,

(Eligible Participants).

2.2. Eligible Participants enter the Promotion on these terms and conditions.

2.3. The Promotor, in its absolute discretion, may change the eligibility criteria at any time during the Promotion Period and subsequently, an Eligible Participant’s eligibility in the Promotion may change prior to the expiry of the Promotion Period.

3. HOW TO ENTER

3.1. To enter in the Promotion, an Eligible Participant must, during the Promotion Period:

(a) purchase a pair of sunglasses from the “TWO SVGE Retro Race collection”;

(b) create a video using the official “TWO SVGE Retro Race” music track and featuring sunglasses from the “TWO SVGE Retro Race collection” (Entry);

3.2. Eligible Participants may submit multiple Entries for the Promotion.

4. SELECTING THE WINNER

4.1. The Promotion is a game of skill and no element of chance determines the winner. The Promotion will have one winner. The winning Entry will be selected based on the following criteria:

(a) creativity & originality – 40%

(b) visual quality & storytelling – 30%

4.2. After the Promotion Period ends, the Promotor’s internal judge panel will assess all valid Entries and in their absolute and sole discretion, select the winning Entry based on the above criteria.

5. PRIZE

5.1. The Eligible Participant who wins the Promotion (the Winner) will receive a $3,000 AUD cash prize (Prize).

5.2. The Prize will be transferred to the Winner’s nominated bank account or PayPal.

6. WINNER ANNOUNCEMENT

6.1. The Winner of the Promotion will be announced on the @twosvge’s Instagram and/or contacted directly through direct message within 7 calendar days after the Promotion Period ends.

6.2. The Winner must respond to accept the Prize within 7 calendar days of the Winner being notified and/or announced. If the Winner does not respond to accept the Prize within 7 calendar days, a new Winner may be selected.

7. LICENCE AND WARRANTIES

By entering this Promotion, you:

7.1. warrant and represent that your Entry does not contain any illegal or defamatory content;

7.2. warrant and represent that you hold the intellectual property rights of your Entry;

7.3. warrant and represent that your Entry does not infringe on the intellectual property rights of any third party;

7.4. grant the Promotor a non-exclusive, royalty-free, worldwide, perpetual licence to use, share, repost, or adapt your Entry across any media for marketing or promotional purposes

7.5. consent to the Promotor using your name, handle, and likeness in relation to your Entry; and

7.6. retain ownership of your Entry.

8. GENERAL CONDITIONS AND DISCLAIMERS

8.1. Each Eligible Participant who enters the Promotion agrees to be bound by these terms and conditions.

8.2. If there is any inconsistency between these terms and conditions and any other information published by the Promotor, these terms and conditions will prevail to the extent of the inconsistency.

8.3. The Promotor reserves the right to remove the Entries of any Eligible Participants who breach these terms and conditions.

8.4. You acknowledge and agree that the Promotor is not responsible for any Entries that are lost, misdirected, or undelivered due to technical or other similar issues.

8.5. The Prize is not transferable and cannot be substituted.

8.6. The Prize does not take into account any tax or transfer costs.

8.7. This Promotion is not open to employees of the Promotor or its related bodies corporate, or any member of their immediate family.

8.8. These terms and conditions are subject to change.

8.9. The Promoter may collect personal information about you for the purposes of the Promotion which will be maintained in accordance with applicable law.

8.10. The terms of the Promotor’s Privacy Policies apply to this Promotion.

8.11. The Promoter, its related bodies corporate, directors, officers, employees, contractors or consultants disclaim all liability for any loss or damage which is suffered or sustained by an Eligible Participant or any third party arising out of or in connection with the Promotion.

8.12. The Promotion is in no way sponsored, endorsed, administered by, or associated with TikTok, Instagram, Meta, or ByteDance. Eligible Participants release these platforms from any liability related to the Promotion.

8.13. This Promotion is void where prohibited by law.

8.14. Eligible Participants are responsible for complying with their local laws and taxes related to competition winnings.

8.15. Eligible Participants residing in the United Kingdom agree that the Promotion is a game of skill and does not constitute gambling under United Kingdom law.

8.16. All currency values listed are in Australian Dollars (AUD).

8.17. These terms are governed by the laws of Western Australia.
